Terms of Service for SpeakBox

Please read these Terms of Service ("Terms") carefully before using the SpeakBox application or website (the "Service") operated by SpeakBox ("we", "our", or "us").

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree with any part of the Terms, you may not use the Service.

1. Introduction
SpeakBox is a real-time multilingual transcription and translation platform offering live audio transcription, instant translation across multiple languages, AI-powered summaries, and local data storage. These Terms govern your use of our Service.

2. Privacy Policy
Your use of the Service is subject to our Privacy Policy, which describes how we collect, use, and protect your data. By using SpeakBox, you consent to the data practices outlined in our Privacy Policy, including ephemeral processing of audio data through third-party transcription providers. 3. User Accounts
You must provide accurate and complete information when creating an account. You are responsible for safeguarding your login credentials and agree not to share your password with others. Notify us immediately of any unauthorized access or security breach.

4. Use of the Service
You agree to use the Service only for lawful and appropriate purposes. Prohibited uses include:
    a. Violating any applicable law or regulation.
    b. Recording conversations without proper consent from all parties (where required by law).
    c. Using the Service to transcribe confidential, classified, or legally protected information without authorization.
    d. Transmitting unauthorized advertising or spam.
    e. Impersonating SpeakBox, its team, or another user.
    f. Infringing on the rights of others, including privacy and intellectual property rights.
    g. Introducing malware or other harmful code.
    h. Using bots or scrapers to access the Service without permission.
    i. Attempting to reverse engineer or circumvent our pay-as-you-go billing system.

5. Audio Data and Local Storage
By using our transcription services, you acknowledge that:
    a. Audio data is processed ephemerally by third-party transcription providers and not stored on our servers.
    b. All transcriptions, translations, and summaries are stored locally on your device.
    c. You are responsible for backing up your local data if desired.
    d. We cannot recover your transcriptions if you lose access to your device or delete the app.
    e. You must comply with all applicable laws regarding audio recording and transcription in your jurisdiction.

6. Intellectual Property
All content and features of the Service, excluding user-generated transcriptions, are the intellectual property of SpeakBox and its licensors. You retain ownership of your audio recordings and transcriptions stored locally on your device. You may not reuse, reproduce, or distribute our app content without permission.

7. Pay-As-You-Go Billing
Our Service operates on a pay-as-you-go model:
    a. Fees: You agree to pay applicable fees for transcription, translation, and AI summary services as displayed in the app.
    b. Current Pricing (subject to change):
       - Real-time transcription: $0.02 per minute
       - Translation services: $0.01 per minute  
       - AI summaries: $0.05 per summary
    c. Billing: Charges are processed via your selected payment method in real-time or through prepaid credits.
    d. No Subscriptions: There are no recurring subscription fees unless you choose an optional subscription plan.
    e. Refunds: Payments are generally non-refundable once services are rendered, unless required by law or in cases of technical failure on our part.
    f. Pricing Changes: We may update pricing and will provide 30 days notice for existing users.

8. Service Availability
While we strive for high availability, we do not guarantee uninterrupted service. The Service may be temporarily unavailable due to:
    a. Scheduled maintenance
    b. Third-party provider outages
    c. Technical issues or emergencies
    d. Force majeure events

9. Termination
We reserve the right to suspend or terminate your account at any time if you violate these Terms. You may delete your account through the app settings or by contacting us at contact@speakbox.com. Upon termination:
    a. Your locally stored data remains on your device
    b. You will not be charged for future usage
    c. Provisions such as intellectual property and limitations of liability will survive termination

10. Disclaimer of Warranties
The Service is provided "as is" without warranties of any kind. We do not guarantee:
    a. The accuracy of transcriptions (though we strive for 95%+ accuracy)
    b. The availability of the Service at all times
    c. That the Service will meet your specific requirements
    d. That transcription will work perfectly in all audio conditions
Use the Service at your own risk.

11. Limitation of Liability
To the maximum extent allowed by law, SpeakBox is not liable for:
    a. Indirect, incidental, or consequential damages
    b. Loss of data stored locally on your device
    c. Damages arising from transcription inaccuracies
    d. Business losses or missed opportunities
Our total liability shall not exceed the amount you paid us in the previous 12 months.

12. Governing Law
These Terms are governed by the laws of the United States. Any legal dispute will be resolved in the courts of the United States.

13. Changes to Terms
We may update these Terms at any time. Material changes will be announced via email or in-app notification with at least 30 days notice. Continued use of the Service after changes means you accept the new terms.
